Terra Lee Brandy Running Crane Sentenced in U.S. District Court

Posted on 22:04 by Unknown

The United States Attorney’s Office announced that during a federal court session in Great Falls on October 1, 2012, before U.S. District Judge Sam E. Haddon, Terra Lee Brandy Running Crane, a 27-year-old resident of Browning and an enrolled member of the Blackfeet Tribe, appeared for sentencing. Running Crane was sentenced to a term of:

■Prison: 57 months
■Special assessment: $100
■Supervised release: three years

Running Crane was sentenced after a federal district court trial in which she was found guilty of assault with a dangerous weapon and assault resulting in serious bodily injury.

At trial, the following evidence and testimony was presented to the jury.

On November 22, 2011, Running Crane floored her green Tahoe directly into a male individual, identified hereafter as “the victim,” as he stood outside a house in Browning, which is within the exterior boundaries of the Blackfeet Indian Reservation. An eyewitness testified that Running Crane was the driver of the vehicle that accelerated into the victim. Running Crane’s boyfriend then hopped in the passenger seat, and they sped off. The victim was left bleeding as he tried to lift himself out of a window at the house that the car ejected him through. Others inside rushed out to help him. He suffered fractures in his ankle, requiring the placement of two skews and a painful skin graft on his back. The Tahoe was later found abandoned in a ditch on the reservation.

Before Running Crane hit and injured the victim, she had been drinking inside with the victim and other individuals. The victim recalled Running Crane’s boyfriend getting tough and aggressive with him. The victim told Running Crane and her boyfriend to leave. The victim, defendant, and her boyfriend all went outside. The victim was chasing off the boyfriend when he was run into by Running Crane driving a green Tahoe. The victim described Running Crane as gunning the car over the sidewalk to strike him.

The victim saw a lot of blood coming from his left arm. His leg was pinned to the wall, and his body went through the window. The vehicle backed up. After being struck, the victim faded in and out of consciousness and stopped breathing at several points. Another individual came to the victim’s aid, kept him awake, and covered him with a blanket. The victim’s injuries included a fractured ankle—requiring surgery, and approximately 34 stitches/staples. He was given potent pain medication. The victim’s injuries also necessitated a skin graft on his back.

The owner of the house and the victim’s sister testified that she looked out a bedroom window and saw a dark green Chevy Tahoe back away from the window. Running Crane was in the driver’s seat. The car was on the curb in front of the residence when Running Crane backed up the Tahoe. Running Crane’s boyfriend was in the passenger seat of the vehicle as it backed away. The victim was on the ground; he tried to get up but could not lift himself. He was bleeding heavily from his left side. Neighbors called 911.

Assistant U.S. Attorney Laura B. Weiss prosecuted the case for the United States.

Because there is no parole in the federal system, the “truth in sentencing” guidelines mandate that Running Crane will likely serve all of the time imposed by the court. In the federal system, Running Crane does have the opportunity to earn a sentence reduction for “good behavior.” However, this reduction will not exceed 15 percent of the overall sentence.

The investigation was a cooperative effort between the Federal Bureau of Investigation and the Blackfeet Law Enforcement Services.

Beaumont Paul Stewart Sentenced in U.S. District Court

Posted on 22:36 by Unknown

The United States Attorney’s Office announced that during a federal court session in Billings, on September 27, 2012, before Chief U.S. District Judge Richard F. Cebull, Beaumont Paul Stewart, a 43-year-old resident of Crow Agency and an enrolled member of the Crow Tribe of Indians, appeared for sentencing. Stewart was sentenced to a term of:

■Prison: 97 months
■Special assessment: $100
■Supervised release: five years

Stewart was sentenced in connection with his guilty plea to aggravated sexual abuse.

In an Offer of Proof filed by Assistant U.S. Attorney E. Vincent Carroll, the government stated it would have proved at trial the following:

In December 2011, a young child told her mother that Stewart had touched her and pointed to her genital area. The victim was subsequently taken to a hospital for a medical exam.

The attending pediatrician conducted the medical exam. During the exam, the victim made specific disclosures about Stewart touching her on her “privates.” The victim also drew pictures indicating where Stewart touched her.

The sexual abuse took place at a residence within the exterior boundaries of the Crow Indian Reservation.

Because there is no parole in the federal system, the “truth in sentencing” guidelines mandate that Stewart will likely serve all of the time imposed by the court. In the federal system, Stewart does have the opportunity to earn a sentence reduction for “good behavior.” However, this reduction will not exceed 15 perfect of the overall sentence.

The investigation was a cooperative effort between the Federal Bureau of Investigation and the Bureau of Indian Affairs.

Shawn Patrick Ellifritt Sentenced in U.S. District Court

Posted on 21:25 by Unknown

The United States Attorney’s Office announced that during a federal court session in Helena on September 20, 2012, before Senior U.S. District Judge Charles C. Lovell, SHAWN PATRICK ELLIFRITT, a 41-year-old resident of Spokane, Washington, appeared for sentencing. ELLIFRITT was sentenced to a term of:

■Prison: 235 months
■Special Assessment: $100
■Supervised Release: four years

ELLIFRITT was sentenced in connection with his guilty plea to distribution of methamphetamine.

In an offer of proof filed by Assistant U.S. Attorney Paulette L. Stewart, the government stated it would have proved at trial the following:

From July 2009 until January 2011, ELLIFRITT provided methamphetamine to a person nicknamed “XX,” who then sold the methamphetamine in Helena.

ELLIFRITT knew that “XX” drove from Helena to Spokane for the methamphetamine and the methamphetamine was headed to Helena for further distribution. ELLIFRITT admitted to receiving over six pounds of methamphetamine over this time period.

ELLIFRITT then sold methamphetamine to “XX.” “XX” obtained two to four ounces of methamphetamine from ELLIFRITT twice a month, for three years with a six- to eight-month gap. A source of information accompanied “XX” on five trips to obtain methamphetamine from ELLIFRITT. “XX” obtained approximately four ounces on each of these trips.

On January 20, 2011, a search warrant executed at ELLIFRITT’s residence resulted in the seizure of approximately a quarter-pound methamphetamine mixture, approximately $7,000 cash, digital scales, security cameras, a TV used with the security cameras, and a digital camera.

The DEA Laboratory tested the substance seized on January 20, 2011, and it had a net weight of 105.7 grams with a purity level of 95 percent.

Because there is no parole in the federal system, the “truth in sentencing” guidelines mandate that ELLIFRITT will likely serve all of the time imposed by the court. In the federal system, ELLIFRITT does have the opportunity to earn a sentence reduction for “good behavior.” However, this reduction will not exceed 15 percent of the overall sentence.

The investigation was a cooperative effort between the Federal Bureau of Investigation, the Montana Department of Criminal Investigation, and the Missouri River Drug Task Force.

The United States Attorney’s Office announced that during a federal court session in Great Falls on September 20, 2012, before U.S. District Judge Sam E. Haddon, IVAN DEAN INGRAHAM, a 21-year-old resident of Browning, appeared for sentencing. INGRAHAM was sentenced to a term of:

■Prison: 33 months
■Special Assessment: $100
■Supervised Release: three years

INGRAHAM was sentenced in connection with his guilty plea to assault with a dangerous weapon.

In an offer of proof filed by Assistant U.S. Attorney Laura B. Weiss, the government stated it would have proved at trial the following:

IVAN DEAN INGRAHAM is an enrolled member of a federally recognized tribe. The following events took place within the exterior boundaries of the Blackfeet Indian Reservation.

On December 11, 2010, IVAN INGRAHAM and Robert Donald Ahenakew kicked in the door of M.H.’s residence and entered the living room area. INGRAHAM had a knife and lunged at M.H. and another individual staying in the house. M.H. indicated he feared that INGRAHAM would harm him with the knife.

Ahenakew pled guilty and has been sentenced.

Because there is no parole in the federal system, the “truth in sentencing” guidelines mandate that INGRAHAM will likely serve all of the time imposed by the court. In the federal system, INGRAHAM does have the opportunity to earn a sentence reduction for “good behavior.” However, this reduction will not exceed 15 percent of the overall sentence.
